Agreement & Binding Scope
These Terms & Conditions constitute a legally binding agreement between you (hereafter the “Primary Guest”, including all registered occupants and accompanying visitors) and Chaka Airbnbs (hereafter the “Management”, “we”, or “us”).
Submitting a reservation request via our website (https://www.chakaairbnbs.co.ke), engaging our reservations desk via WhatsApp or telephone, or taking physical occupancy of any residence in Chaka Town confirms that you have read, understood, and agreed to be bound by every clause in this agreement without qualification.
Statutory Guest Identification & Compliance
In compliance with the Tourism Act (2011), the Tourism Regulatory Authority (TRA) regulations, and security directives issued by the Ministry of Interior of the Republic of Kenya:
- Mandatory Identification: Every adult guest (18 years and above) must present a valid, government-issued photo identity document at check-in (Kenyan National Identity Card for citizens; valid International Passport and valid entry stamp/visa for foreign nationals).
- Guest Register: All occupants must be recorded in the physical or electronic official guest ledger prior to the issuance of suite access keys.
- Right of Refusal: Management reserves the absolute right to deny access to any individual who fails or refuses to produce verifiable statutory identification, without entitlement to refund or compensation.
Reservation Framework & Pay on Arrival Guarantee
We operate an authentic, friction-free hospitality model designed to eliminate third-party online travel agency (OTA) markups and credit card fraud risks:
- Zero Upfront Card Storage: We do not require, charge, or store credit card details or CVVs on our servers.
- Reservation Holds: Upon submitting a stay request online, your desired dates are held tentatively. A booking is formally confirmed once your WhatsApp verification is validated with our concierge desk (+254 115 770505).
- Settlement at Check-In: Full payment for the entire stay period is payable immediately upon your physical arrival at the compound, following your inspection of the assigned residence and before room keys are handed over.
- Unconfirmed Holds: Management reserves the right to release unconfirmed reservation requests if the guest remains unreachable via call or WhatsApp 24 hours prior to scheduled arrival.
Tariffs, Currency, Taxes & Invoicing
All standard nightly rates published on our website are denominated in Kenya Shillings (KES):
- Authorized Payment Methods: We accept official Safaricom M-Pesa (Buy Goods Till / Official Paybill), direct bank electronic funds transfers (EFT/RTGS for verified corporate accounts), and physical Kenya Shilling cash. Personal third-party bank cheques are strictly not accepted.
- Foreign Currencies: Settlements in USD, EUR, or GBP are permissible only by prior written agreement with management, calculated at the prevailing commercial banking exchange rate on the day of check-in.
- Inclusions: Published nightly tariffs include exclusive use of the furnished apartment, gas and induction utilities, water, high-speed Wi-Fi, 24/7 guarded security, and gated on-site vehicle parking.
Cancellation, Rescheduling & No-Show Policy
We understand travel plans across the Mount Kenya and Aberdares highlands can change:
- Free Cancellation: Guests may cancel or reschedule their reservation with zero penalty up to 48 hours prior to 12:00 PM on the scheduled arrival date by notifying the concierge via WhatsApp (+254 115 770505) or telephone.
- Late Cancellation & No-Shows: If you cannot fulfill your booking, we require prompt courtesy communication. Guests who fail to arrive without notification cause unrecoverable room lockouts; management reserves the right to decline future direct reservation requests from chronic no-show accounts.
- Early Departures: Once checked in, paid accommodation fees for reserved nights are non-refundable, as the calendar dates have been blocked from other prospective travelers.
Check-In & Check-Out Timings
Strict timing discipline protects the sanitization and housekeeping cycles between departing and arriving parties:
- Check-In Window: From 12:00 PM (Noon) to 9:00 PM on the arrival date. Late check-ins after 9:00 PM must be arranged with concierge in advance to coordinate gate access and night-guard reception.
- Check-Out Time: Strictly by 11:00 AM on the date of departure.
- Late Check-Out: Extensions past 11:00 AM are subject strictly to suite availability and written management approval. Unauthorized late departures exceeding one hour impede incoming cleanings and will incur a late departure fee equivalent to 50% of the daily rate (or a full night’s rate if past 2:00 PM).
Occupancy Ceilings & Prohibition of Sub-Letting
Each residence carries a strict structural occupancy threshold determined by bed configurations and local council safety norms:
- Two Bedroom Home: Maximum 4 to 6 guests.
- One Bedroom Home: Maximum 2 adult guests.
- One Bedroom (Twin Beds): Maximum 2 to 4 guests.
- Cozy Bedsitter: Maximum 1 to 2 guests.
- Unregistered Overnight Guests: Non-registered visitors are not permitted to stay overnight without prior declaration to management and payment of applicable supplementary guest fees.
- Strictly No Sub-Letting: Guests are strictly prohibited from transferring, sub-letting, assigning, or commercializing their reservation or residence access to any third party. Violation results in immediate revocation of access without refund.
Quiet Hours, House Rules & Strict Non-Smoking Policy
To preserve the tranquility and residential character of our sanctuary:
- Quiet Hours (10:00 PM – 7:00 AM): In compliance with the National Environment Management Authority (NEMA) Noise and Excessive Vibration Regulations, sound levels must be kept low. Outdoor loudspeakers, excessive bass, and boisterous late-night assemblies are strictly forbidden.
- Strict Non-Smoking Indoors: Smoking, vaping, or burning of shisha/incense is strictly prohibited inside all apartments, living rooms, bedrooms, and bathrooms. Designated outdoor smoking areas are available within the open compound. A specialized decontamination and ozone cleaning charge of KES 10,000 will be billed to any guest who breaches this rule.
- Prohibition of Unlawful Conduct: Use of illicit substances, commercial prostitution, unauthorized commercial filming, or possession of unlicenced firearms on the premises is grounds for immediate eviction and referral to the National Police Service (Chaka / Kiganjo Police Station).
Security, Gated Compound & Vehicle Parking
Your physical security is paramount throughout your highland stay:
- 24/7 Guarded Perimeter: The property is fully enclosed by perimeter walling and guarded round-the-clock by dedicated physical security guards.
- CCTV Surveillance: External CCTV cameras monitor entry gates, perimeter perimeters, and vehicle parking bays. We uphold absolute indoor privacy: zero cameras exist inside any private suite, room, or corridor.
- Vehicle Parking: Complimentary secure parking is provided on-site. While our guarded perimeter and cameras maintain rigorous vigilance, vehicles and contents are parked at the owner’s risk. Management is not liable for valuables left unattended inside parked vehicles.
Property Care, Damage Liability & Key Custody
Guests are expected to treat the residences and amenities with the same respect as their own home:
- Inspection & Handover: Upon check-in, guests are encouraged to inspect appliances, furniture, and fittings. Any pre-existing flaws should be noted to staff immediately.
- Damages & Breakages: Any accidental or intentional damage to property, stained linens, broken glassware, damaged cookware, damaged electronics, or defaced furnishings will be evaluated and billed to the primary guest at fair market replacement value.
- Lost Suite Keys: Loss of physical suite keys or gate remotes necessitates immediate lock-cylinder replacement for security purposes. A replacement fee of KES 3,500 will be levied per occurrence.
Utilities, Connectivity & Maintenance Access
We strive for seamless, continuous residential services throughout every stay:
- Complimentary Wi-Fi: High-speed Wi-Fi is provided for guest convenience (work, streaming, communication). Guests agree not to utilize the network for unlawful activities, copyright infringement, or malicious network actions.
- Utility Continuity: Electricity is supplied via the national grid (Kenya Power) and water via municipal/borehole storage. In the rare event of public utility load shedding or regional infrastructure downtime, backup water reserves and emergency lighting are deployed. Management is not liable for public utility failures beyond reasonable control.
- Right of Emergency Access: Management or designated maintenance contractors reserve the right to enter any suite at reasonable hours (with prior notice to the guest where feasible) for emergency repairs, safety audits, or water/electrical inspections.
Outside Catering & Event Culinary Services
For clients commissioning our outside catering services (ruracio, dowries, private celebrations, corporate events):
- Menu Contracts & Commitments: A binding menu estimate and guest count must be finalized at least 7 days prior to the event date.
- Sourcing Deposit: A minimum commitment deposit of 50% is required upon quotation acceptance to secure food ingredients, logistics, and private chef allocations, with the final balance due prior to meal service.
- Food Safety & Dietary Notes: Clients are responsible for notifying our culinary desk of any specific guest food allergies or religious dietary specifications during the quotation stage.
Limitation of Liability & Guest Indemnity
To the fullest extent permitted under the Laws of Kenya:
- Personal Property & Valuables: Management shall not be responsible for any loss, theft, or damage to personal valuables, cash, jewelry, laptops, or luggage brought onto the premises. Guests are urged to secure their residence deadbolts and windows when leaving unattended.
- Personal Injury: Management accepts no liability for personal injury, illness, accident, or loss sustained by any guest or visitor on the property or during transit, save where directly caused by the proven gross negligence of management.
- Indemnification: The Primary Guest agrees to indemnify and hold harmless Chaka Airbnbs, its directors, and staff against any third-party claims, legal expenses, fines, or losses arising from breaches of house rules or illegal acts committed by members of their party.
Governing Law & Dispute Resolution (Kenya)
This agreement, its interpretation, and all relationships between guests and Chaka Airbnbs shall be governed exclusively by and construed in accordance with the Laws of the Republic of Kenya.
Any dispute, claim, or controversy arising out of or relating to your reservation or stay shall first be addressed through good-faith amicable dialogue with our Management Desk. If unresolved within 30 days of written notice, the parties agree to submit to the exclusive jurisdiction of the competent courts of law sitting in Nyeri County, Kenya.
